Kritzer Law Group Secures Defense Verdict in NYC Bus Accident

Kritzer Law Group trial attorney Rocco Iervasi secured another defense victory on April 30, 2024, in a Supreme Court Kings County case before the Honorable Caroline Cohen. The case involved a two-vehicle accident on Linden Boulevard when the plaintiff's van and a New York City Transit Authority bus were involved in a side-swipe collision.

The 60-year-old plaintiff claimed the accident caused lower back injuries requiring lumbar fusion surgery. However, Mr. Iervasi's meticulous strategy led the jury to a different conclusion.

Right-of-Way Key to Defense Win

Over a two-day trial, Mr. Iervasi established that the bus had completed a stop on the service road of Linden Boulevard and established itself in the moving lane before the plaintiff's van attempted to enter the lane. As such, Mr. Iervasi successfully established that the plaintiff was required to yield the right-of-way to the Transit Authority bus which was already traveling on the service road before this accident. This crucial detail secured a verdict in favor of the defendant in just 20 minutes. The jury agreed that the plaintiff failed to yield the right of way, causing the collision.
